The opportunity to purchase post-season tickets is a privilege offered only to season ticket members whose accounts are and remain in good standing and may be revoked at any time by DLI in its sole discretion. A season ticket member's opt-in to purchase post-season tickets and/or acceptance by DLI of any payment therefor is entirely conditional and DLI may refuse to deliver post-season tickets, or may subsequently cancel tickets previously delivered, to a season ticket member whose account does not remain in good standing or is revoked for any reason, including but not limited to non-payment, violations of DLI's ticketing policies then in effect, or violations of the Ford Field Fan Code of Conduct. In such case the season ticket member account holder's sole remedy for such revocation or cancellation is a refund of the amounts paid, if any, for such post-season tickets not delivered or later cancelled.

This Agreement shall be governed by and construed in accordance with the internal laws of the state of Michigan without regard to its conflict of laws principles that could cause the application of laws of another jurisdiction. Each party consents to exclusive jurisdiction in any proper court located in Wayne County, Michigan for resolution of any dispute under or in connection with this Agreement. Notwithstanding the foregoing, the parties each agree that either party may unilaterally require that any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate and waiver of class action, shall be resolved exclusively by final and binding individual arbitration in Detroit, Michigan. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those Rules. Judgment on the award may be entered in any court having jurisdiction. If DLI or Member elect to resolve a dispute by arbitration, neither will have the right to a court or jury trial or to participate in a class action or class arbitration. Other customary rights that DLI and Member otherwise have if either went to court will not be available or will be more limited in arbitration, including the right to appeal. DLI and Member each understand and agree that by allowing each other to elect to resolve any dispute through individual arbitration, EACH IS WAIVING THE RIGHT TO A COURT OR JURY TRIAL. IF EITHER PARTY ELECTS ARBITRATION, THE APPLICABLE DISPUTE SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.
